Section 8.21. Yard Sales
Yard sale for purposes of this Article shall be defined to mean and include all general sales open to the public conducted on residential premises in any district for the purpose of disposing of personal property, including but not limited to all sales entitled “garage”, “lawn”, “yard”, “attic”, “porch”, and/or “patio” sale; but which in no way shall be construed to include “flea market” which is specifically excluded herefrom.
(a) A no charge 4 day permit shall be obtained at the Code Compliance Division. The maximum number of “permits’’ which may be issued to any person or location per calendar year is two (2). Yard sales are limited to four (4) consecutive days.
(b) Only personal property may be offered for sale. Personal property for purposes of this Article is that which is owned, utilized, maintained and acquired during the course of living in and maintaining a residence by an individual or members of the household, and shall specifically exclude merchandise which was purchased for resale or obtained on consignment.
(c) Yard sale signage is permitted following the requirements of Section 11.3.(s).
(d) Off-premises directional signs are prohibited in all districts.
11.3.(s) Yard Sale Signs. [Permitted for all uses]
(1) An informational sign identifying the location of a yard sale.
(2) Only one such sign shall be permitted on the lot where the yard sale is located.
(3) Such sign shall not exceed 2 square feet in area per side and 30 inches
in height.
(4) Such sign shall remain in place only from 5 p.m. on the day before until 8AM
on the day after the sale.
(5) No off-premise directional signage is permitted for yard sales.
NOTE: All vehicles must be parked OFF the paved roadway. Roadways must be clear to allow emergency vehicles access to the area.
